Terms and Conditions

These terms and conditions apply to every order placed via masculino.eu. Please read them carefully before placing your order. By placing an order, you agree to these terms and conditions.

1. Definitions

In these terms and conditions, the following terms have the meaning set out below:

Masculino, we, us:, trading as Masculino, the seller of the products offered on masculino.eu.
Customer, you: the natural person or legal entity that places an order with Masculino.
Consumer: a customer who is a natural person and does not act for purposes related to a trade, business, craft or profession.
Contract: the distance contract concluded between Masculino and the customer for the purchase of products.
Products: the watches, straps, travel cases and other items offered on masculino.eu.
Withdrawal period: the 14-day period within which a consumer can cancel the contract.
Durable medium: any means, such as email, that allows the customer or Masculino to store information addressed to them personally.

3. Applicability

These terms and conditions apply to every offer made by Masculino and to every contract concluded between Masculino and the customer via masculino.eu.
Before the contract is concluded, these terms and conditions are made available to you on our website, in a way that allows you to store and print them.
Any deviation from these terms and conditions is only valid if agreed in writing (including by email).
If a provision of these terms and conditions is void or annulled, the remaining provisions remain in full force. The invalid provision will be replaced by a provision that comes as close as possible to its original purpose.
For purchases by retailers and other business customers, separate agreements apply. Please contact us for more information.

4. The offer

Our offer contains a complete and accurate description of the products. We do our best to show the products as accurately as possible in images and descriptions. Minor differences, for example in colour due to screen settings, cannot give rise to compensation or cancellation of the contract, without prejudice to your legal rights.
All offers are valid while stocks last.
Obvious mistakes or errors in the offer, such as a clearly incorrect price, do not bind Masculino. If such a mistake occurs, we will contact you and you may choose to cancel the order free of charge.

5. Conclusion of the contract

The contract is concluded when you complete the ordering process on masculino.eu, including payment.
After placing your order, you will receive an order confirmation by email. Please check this confirmation carefully and contact us immediately if anything is incorrect.
To place an order, you must be at least 18 years old, or have permission from a parent or guardian.
Masculino may refuse or cancel an order with good reason, for example in case of suspected fraud or if a product is unexpectedly out of stock. In that case, we will inform you as soon as possible and refund any amount already paid within 14 days.

6. Prices and shipping costs

All prices on masculino.eu are in euros and include VAT.
Shipping costs are shown separately before you complete your order. Currently, delivery within the Netherlands is free of charge. For deliveries to other European countries, shipping costs of €7.50 apply.
The price stated at the time of your order applies. Price changes after the contract has been concluded do not affect your order.
Any import duties or local taxes for deliveries outside the European Union are at the customer’s expense. [Remove if you only ship within the EU.]

7. Payment

Payment is made in advance, using one of the payment methods offered on masculino.eu, such as [iDEAL, credit card, PayPal, Bancontact].
Payments are processed securely by our payment provider [name].
We only ship your order once payment has been successfully received.

8. Delivery

We deliver to the address you provide when placing your order. You are responsible for providing a correct and complete address.
Orders within the Netherlands placed on working days before 16:00 are usually delivered within approximately 2 working days. Delivery within Europe usually takes 1 to 10 working days. These delivery times are indicative.
As soon as your order has been shipped, you will receive a track & trace code by email.
We aim to deliver every order as quickly as possible and in any case within 30 days. If delivery is delayed or not possible, we will inform you as soon as possible. In that case, you may cancel the order free of charge and we will refund the amount paid within 14 days.
The risk of loss of or damage to the products passes to you at the moment the products are delivered to you or to a person designated by you (other than the carrier).
The products remain the property of Masculino until the full purchase price has been paid.

9. Right of withdrawal and returns

As a consumer, you have the right to cancel your purchase within 14 days of receiving the product, without giving any reason.
The conditions, the return procedure, return shipping costs and the refund are described in detail in our Return & Refund Policy, which forms part of these terms and conditions. This policy also includes the model withdrawal form.
During the withdrawal period, you must handle the product and its packaging with care. You may only inspect the product to the extent necessary to judge its nature, characteristics and functioning. If you go beyond this, you may be liable for any resulting loss of value.

10. Conformity and warranty

Masculino guarantees that the products comply with the contract, the specifications stated in the offer and the reasonable requirements of soundness and usability.
In addition to your statutory rights, every Masculino product comes with a warranty of 2 years from the date of purchase, covering all defects caused by manufacturing faults.
The warranty does not cover normal wear and tear, damage caused by accidents, improper use, exposure to water beyond the stated water resistance, or repairs and other work carried out by third parties.

The warranty offered by Masculino never limits the statutory rights you have as a consumer.

11. Complaints

If you have a complaint about a product or our service, please contact us as soon as possible at info@masculino.eu, with a clear description of the complaint and, where relevant, photos.
We will confirm receipt of your complaint and respond with a substantive answer within 14 days. If a complaint requires more time, we will let you know within 14 days when you can expect an answer.
We always aim to find a suitable solution together with you.

12. Liability

Masculino’s liability is limited to the amount of the purchase price of the product concerned, except in case of intent or gross negligence on our part.
Masculino is not liable for indirect damage, such as consequential loss or loss of profit.
Nothing in these terms and conditions limits or excludes liability that cannot be limited or excluded under mandatory law, including your rights as a consumer.

13. Force majeure

Masculino is not liable for failure to fulfil its obligations if this is caused by circumstances beyond our control, such as disruptions at suppliers or carriers, natural disasters, strikes, pandemics or government measures. In that case, we will inform you as soon as possible. If the situation lasts longer than 30 days, both you and Masculino may cancel the contract, and any amount already paid will be refunded.

14. Intellectual property

All content on masculino.eu, including texts, photos, videos, logos, product designs and the Masculino brand name, is the property of Masculino or its licensors. You may not copy, reproduce or use this content for commercial purposes without our prior written permission.

15. Privacy

We handle your personal data with care and in accordance with the GDPR. How we do this is explained in our Privacy Policy.

16. Changes to these terms and conditions

Masculino may change these terms and conditions from time to time. The version applicable to your order is the version published on the website at the time you placed your order.

17. Applicable law and disputes

These terms and conditions and all contracts with Masculino are governed by Dutch law.
If you are a consumer living in another EU country, you also keep the protection of the mandatory provisions of the law of your country of residence.
Disputes will be submitted to the competent court in the Netherlands, unless mandatory law requires otherwise. As a consumer, you may also bring a dispute before the competent court in your country of residence.
